Acceptance of Agreement
BY ACCESSING AND USING THE SITE and related site(s), YOU (“User”) AGREE TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN (the “Agreement”). If User is accessing and using this website on behalf of any group or entity, User warrants that he/she has all necessary authority to enter into this Agreement. If at any time User does not agree to be bound by the terms and conditions of this Agreement, then User must cease using the site immediately.
Modifications to Terms of Service
User is granted a non-exclusive, non-transferable, revocable, limited license to access and use Innovation School for his/her own use and not for commercial use. StartEdUp may terminate this license without notice at any time and for any, or no, reason.
User may not copy, download, store, publish, transmit, transfer, sell, sublicense or otherwise use the sites, or any portion thereof, in any form or by any means, except (i) as expressly permitted by this Agreement, (ii) with StartEdUp’s prior written permission, or (iii) if not expressly prohibited by this Agreement, as allowed under the fair use provision of the Copyright Act (17 U.S.C. § 107). User may not alter or modify information and services provided through the sites in any way. User may not reverse engineer, decompile, disassemble or otherwise attempt to discern the source code or architecture of the components of the sites, or any information about usage or users. User may not use any robot, spider, other automatic device, or manual process to access, monitor or copy sites without StartEdUp’s prior written permission.
Intellectual Property Rights
Copyright or other intellectual property laws protect the information available through the sites. You may display, print and/or save originally created content, with the exception of instructor lecture videos, obtained through the sites solely for your own personal, non-commercial use. You may only display the instructor lecture videos for your own personal, non-commercial use. You may not reproduce, retransmit, distribute, store in a retrieval device, disseminate, sell, publish, broadcast or circulate the original content obtained through the service to anyone, without the express written consent of StartEdUp. You agree to keep your unique password and user ID private for your own personal or business use. Any sharing of your password and user ID is strictly prohibited by this agreement, and could result in the termination of your subscription and further legal actions as provided and protected by United States copyright laws. You agree not to use any information obtained through the Service for any unlawful or unauthorized purpose.
Additional permissions may be granted to purchasers of multi-user licenses, which will be outlined in a multi-user license agreement. Please contact firstname.lastname@example.org for additional information.
You may display, print and/or save content created by 3rd parties as long as you do not alter the content and properly credit the original source according to copyright standards. However, you may not share the content collectively in a manner that would constitute recreation of course curriculum.
Bond School is accessible via startedup.instructure.com and requires registration for access and use. If User elects to register, User agrees to provide StartEdUp with accurate, complete registration information. User will inform StartEdUp of any changes to registration information. User warrants that registration is for a single person only, unless otherwise noted, and that User will not permit anyone other than User to access and use services requiring registration using User’s name and password. User will not access or use Innovation School under the User name of another individual. User is responsible for all access to and use of the sites through User’s name and password, including access of any services the use of which results in monetary charges to User, whether or not User has knowledge of or authorizes such access and use. User will notify StartEdUp immediately of any unauthorized use of User’s name and password; if User suspects the privacy of User’s name and password has been jeopardized; or if User believes that another individual has fraudulently represented themselves as the User or as being associated with User or User’s organization.
You must be at least 18 years old in order to participate on our site(s). We will not knowingly collect personally identifiable information from anyone under the age of 18. However, if you are under the age of 18, but over the age of 13, and have obtained the consent of your parent or legal guardian, you may view the site as a Visitor only. Further, you may not make use of the site if such use violates any applicable law or regulation. You agree to abide by these restrictions and not to help anyone avoid these restrictions.
Lawful Use Only
User will not publish, upload, submit or distribute any materials on our site(s) which are unlawful, deceptive, misleading, or abusive in any way, including but not limited to materials that are defamatory, libelous, pornographic, obscene, threatening, indecent, invasive of privacy or publicity rights, hateful, or would constitute or encourage a criminal offense, violate the rights of any party, contain any corrupted data or malicious code that may impair or alter the appearance or functionality of our sites, or give rise to liability or violation of any local, state, federal or international law or regulation, either intentionally or unintentionally.. StartEdUp may delete any of User’s Posted Materials at any time, without prior notice or User’s permission and at StartEdUp’s sole discretion.
Posted Materials Attributed & Truthful
On certain sections of Innovation School, Posted Materials submitted for publication will be accompanied by User’s name and shall not be submitted anonymously. User warrants that such Posted Materials will not misrepresent or obscure his or her identity or affiliation with any person or entity. Furthermore, User warrants that it will not, by any method or action, directly or through a third party, seek to artificially enhance, degrade, or otherwise manipulate the recommendations or endorsements of any User, individual, or group on Innovation School including User’s own.
(No) Obligation to Monitor
StartEdUp reserves the right but has (no) obligation or intent to edit, monitor or screen Posted Materials and is (not) responsible for the content in, or linked to or from, Posted Materials. StartEdUp may, and retains the right to, examine Innovation School for adherence to the Agreement and remove any materials that may be objectionable, violate the Agreement, or law, but expressly disclaims any and all warranties or representations that it will do so in any specific instance. By using Innovation School, User acknowledges and agrees that StartEdUp is under no obligation to monitor, edit, or remove any Posted Materials solely upon User’s insistence.
Commercial Use Prohibited
Services on the site(s) that allow User to contact, communicate or interact with other users including any StartEdUp affiliates or customers (“Interactive Services”) are provided to User solely for personal use. User will not include any advertising, promotion, solicitation for goods, services or funds, or solicitation for anyone to become members of a commercial enterprise or organization in Posted Materials delivered through Interactive Services without the express written permission of StartEdUp.
Third Party Content
Third party content, messages and services may appear on our sites or may be accessible through links from Innovation School. StartEdUp is not responsible, and assumes no liability, for any mistakes, misstatements of law, defamation, slander, libel, omissions, falsehood or obscenity in the statements, opinions, representations or any other form of content contained in any third party content appearing on or accessible from Innovation School. User acknowledges that the information and opinions in the third party content are neither endorsed or controlled by, nor reflect the beliefs of, StartEdUp or its’ affiliates.
Advertisers & Sponsors
User acknowledges that our sites may contain advertising and sponsorships. If this occurs, the information provided will be clearly labeled as advertisement and/or sponsorship. Advertisers and sponsors are solely responsible for ensuring that material submitted is accurate and complies with any and all applicable laws. User agrees that StartEdUp will not be responsible for the illegality or any error or inaccuracy in advertisers’ or sponsors’ materials or for the acts or omissions of advertisers or sponsors.
User agrees to defend, indemnify, and hold StartEdUp, its affiliates, contractors, suppliers, directors, employees and agents harmless from any and all claims, costs, damages, judgments, and liabilities (including but not limited to reasonable attorney’s fees) made by any third party and arising from any content User posts, submits, transmits or otherwise makes available through StartEdUp, User’s violation of the terms and conditions of this Agreement, or the violation of the intellectual property rights of any third party.
Limitation of Claims
Except for claims relating to improper use of StartEdUp, no claim, regardless of form, which in any way arises out of this Agreement, may be made, if such claim is brought, under this Agreement more than one year after the basis for the claim becomes known to the party desiring to assert it.
User is solely responsible for its interactions with other StartEdUp users. StartEdUp retains the right, but expressly disclaims any obligation, to become involved in any dispute between User and any other users of StartEdUp.
This Agreement embodies the entire understanding between User and StartEdUp with respect to the subject matter herein, and supersedes any and all prior understandings and agreements, oral or written, relating to the subject matter.
StartEdUp’s performance under these Terms and Conditions of use are subject to interruption and delay due to causes beyond its reasonable control, such as acts of God, acts of any government, war or other hostility, civil disorder, the elements, fire, explosion, power failure, equipment failure, industrial or labor dispute, inability to obtain necessary supplies and the like.
Legal Compliance / Jurisdictional Issues
StartEdUp is controlled and operated from our offices in the United States. We do not represent that materials on the site are appropriate or available for use in other locations. Visitors who choose to access the site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree to comply with all applicable domestic and international laws. Statutes, ordinances and regulations regarding your use of Innovation School and the content and materials provided therein.
This Agreement will be governed by and construed under the law of the State of California, U.S.A. without regard to conflicts of law provisions. The parties agree that the state and federal courts sitting in California will have exclusive jurisdiction over any claim arising out of this Agreement and each party consents to the exclusive jurisdiction of such courts. Neither this Agreement nor any part or portion may be assigned, sub-licensed or otherwise transferred by Subscriber without StartEdUp’s prior written consent. Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions will not be affected thereby. Failure of any party to enforce any provision of this Agreement will not constitute or be construed as a waiver of such provision or of the right to enforce such provision. The headings and captions contained in this Agreement are inserted for convenience only and do not constitute a part of this Agreement.
A. COMMUNITY GUIDELINES
We welcome your participation in the discussions at StartEdUp, Innovation School and our related social media sites. These guidelines were created to help our community better understand how to contribute content and participate in our group discussions.
StartEdUp is not responsible for any and all content, comments, opinions provided by Content Providers, Guests or Group Leaders.
a. Members shall not provide any information that is knowingly false, misleading or inaccurate.
b. Members shall not use any portion of StartEdUp for any unlawful purpose and will comply with all applicable domestic and international laws, statutes, ordinances and regulations.
c. Members shall not use any portion of StartEdUp for uploading, posting, e-mailing, transmitting or otherwise making available Member Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. Only the owner or a representative designated by the owner may upload copyrighted material to StartEdUp.
d. Members shall not use any portion of Innovation School for uploading, posting, emailing, transmitting or otherwise making available Member Content that is harmful to minors in any way, harassing, harmful, threatening, abusive, vulgar, obscene, defamatory, libelous, hateful, or racially, ethnically or otherwise objectionable.
e. Members shall not use any portion of Innovation School for uploading, posting, emailing, transmitting or otherwise making available junk mail, commercial advertisements, or any other form of commercial solicitation.
f. Members shall not attempt to interfere with any other person’s use of Innovation School.
g. Members shall not misrepresent their identity nor impersonate any person.
h. Members shall not hold themselves out as sponsored by, endorsed by, or affiliated with StartEdUp.
i. Members shall not attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Fixed IncomeAcademy.com in connection with StartEdUp website(s).

B. SUBSCRIPTION AGREEMENT
If you agree to be bound by the terms of this Agreement, you should click on the “I AGREE” button at the end of this Agreement. If you do not agree to be bound by the terms of this Agreement, you will not be able to proceed with the registration process for the respective Service and become a subscriber. To the extent you have access to, or are using, a Service without having completed our registration process or clicked on an “I AGREE” button, you are hereby notified that your continued use of a Service is subject to many of the terms and conditions of this Agreement as explained below.
Innovation School may change the terms of this Agreement including, without limitation, the fees for the Service or for any information products on the Service at any time by notifying you of the change in writing or electronically (including without limitation, by email or by posting a notice on the Service that the terms have been “updated”). You signify that you agree to be bound by such changes by using a Service after changes are made to this Agreement.
StartEdUp may discontinue or revise any and all aspects of the Service or any of the information products on the Service at its sole discretion and without prior notice.
In no event shall StartEdUp be liable for any damages caused by the inability of the Subscriber to access the Service as a result of network or server downtime, transmission problems or otherwise. StartEdUp does not guarantee the uptime of the Services.
Copyright or other intellectual property laws protect all information available through the Service. You may display and print information obtained through the Service solely for your own personal, non-commercial use. You may not reproduce, retransmit, distribute, store in a retrieval device, disseminate, sell, publish, broadcast or circulate the information obtained through the Service to anyone, without the express written consent of StartEdUp. You agree to keep your unique password and user ID to yourself, for your own personal or business use. Use of Discount Coupons
StartEdUp uses coupon codes to provide discounts to 1) Users that are members of affiliated organizations and education partners, 2) The general public for promotional purposes, 3) For course giveaways and contests and/or 4) For other purposes as deemed necessary by StartEdUp. Coupon codes may only be used once per User unless StartEdUp has granted permission in writing. Coupon codes may not be shared with other Users without the expressed permission of StartEdUp. Users who register using coupon codes that are not eligible to receive the discount, or Users who use the coupon codes beyond their intended purpose may be required to reimburse the discounted amount to StartEdUp or may be dropped from the course at the complete discretion of StartEdUp.
Refund Policy for StartEdUp Courses
Users are entitled to a full refund within three days of purchase, minus a $10 processing fee. After the third business day, all purchases will be final and nonrefundable. Refunds will be issued to the original payment method within 30-45 business days. Refunds must be submitted in writing within 3 business days of purchase.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
YOUR USE OF THE SITE IS AT YOUR SOLE RISK. ANY CONTENT OR INFORMATION CONTAINED WITHIN THE SITE IS PROVIDED “AS IS” WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, CURRENT DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SITE AND ANY SITE-RELATED MATERIALS. IN ADDITION, INNOVATION SCHOOL DOES NOT WARRANT THAT THE FUNCTIONS ON THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS IN OR ON THE SITE WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. UNDER NO CIRCUMSTANCES WILL STARTEDUP BE LIABLE IN ANY WAY FOR ANY MATERIAL, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY MATERIAL POSTED, EMAILED OR OTHERWISE TRANSMITTED VIA THE SITE.

Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE TO THE FOLLOWING:
THAT UNDER NO CIRCUMSTANCES WILL INNOVATION SCHOOL , ITS PARENT, AFFILIATES OR SUBSIDIARIES, THEIR SPONSORS, CONTRACTORS, SPONSORS, VENDORS OR OTHER PARTNERS, ANY OF THEIR SUCCESSORS, ASSIGNS OR LICENSEES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, EMPLOYEES (COLLECTIVELY “RELEASED PARTIES”) BE RESPONSIBLE OR LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE, THE USE OR THE INABILITY TO USE THE SITE, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, THE MATERIALS AVAILABLE ON THE SITE, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OR IN CONNECTION WITH THE SITE OR ANY OTHER MATTER RELATING TO THE SITE INFORMATION CONTAINED WITHIN THE SITE, EVEN IF ANY OF THESE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY DAMAGES.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR SITE-RELATED MATERIALS IS TO STOP USING THE SITE. YOU AGREE THAT THIS LIMITATION OF LIABILITY AND RELEASE IS MADE WITH THE KNOWING INTENT OF RELEASING ALL KNOWN AND UNKNOWN CURRENT AND FUTURE CLAIMS AND WITH THE INTENT OF WAIVING ALL RIGHTS UNDER CALIFORNIA CIVIL CODE SECTION 1542 OR OTHER LAWS REQUIRING SIMILAR WAIVERS TO BE KNOWINGLY MADE.
STARTEDUP AND ITS SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND LICENSORS (STARTEDUP) WILL NOT BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANY OTHER PERSON AS A RESULT OF YOUR ACCESS OR USE OF THE SERVICES FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST SAVINGS AND LOST REVENUES (COLLECTIVELY, THE “EXCLUDED DAMAGES”), WHETHER OR NOT CHARACTERIZED IN NEGLIGENCE, TORT, CONTRACT, OR OTHER THEORY OF LIABILITY, EVEN IF ANY OF THE STARTEDUP PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN ANY OF THE EXCLUDED DAMAGES, AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE STARTEDUP PARTIES’ LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.
